Conditional import and export aquatic species and breeds

The Ministry of Agriculture and Rural Development has just issued Circular No. 04/2015 / TT-BNNPTNT guiding the implementation of some contents of the Government’s Decree No. 187/2013 / ND-CP of November 20, 2013.

In which, the list of 10 conditional export species, 16 conditional import aquatic species and 9 environmental treatment and improvement products used in aquaculture with conditional import will be specified. Specifically: List of 10 species of conditional export, including: ghost lobster, rock lobster, red lobster, hairy lobster, cotton lobster, blue lobster, gray lobster, grouper species (grouper ), orange (black striped orange), milkfish, freshwater yellow grouper, basa, catfish, pointed eel, flower eel, ebony eel, Japanese eel, copper frog, sea crab. Aquatic species on the list of conditional export aquatic products mentioned above if they fully meet the conditions in Appendix 02 of the Circular, when exporting, traders shall carry out customs procedures. For aquatic species under CITES management, the regulations of CITES Vietnam shall apply. List of 16 seafood varieties with conditional import, including: Russian sturgeon, sturgeon sturgeon, sturlet sturgeon, beluga sturgeon, elephant snail, king crab, Canadian lobster / American lobster, clams Scallop, Eastern / American virtually, Pacific, green mussel, Dungeness crab, snow crab, Atlantic sea snail, Mediterranean mussel, Manila oyster.

Aquatic breeds on the list of aquatic breeds permitted for production and business promulgated by the Ministry of Agriculture and Rural Development (the ordinary import list) or written certifications of new aquatic breeds, when being imported, traders shall carry out the procedures. import at the customs office and carry out quality inspection in accordance with Circular No. 26/2013 / TT-BNNPTNT dated May 22, 2013 issued on the management of aquatic breeds. Aquatic breeds which are not yet included in the List of aquatic breeds permitted for production and business promulgated by the Ministry of Agriculture and Rural Development (the ordinary import list) or the List of aquatic breeds subject to conditional import specified in Appendix 3. Attached to this Circular or no document recognizing new aquatic breeds, when imported, must be licensed by the General Department of Fisheries for testing, research and introduction at fairs and exhibitions. The order and procedures for licensing are specified in Clauses 3, 4, 5, 6, 7 and 8 of Article 32 and Article 6 of the Circular.

In addition, the Circular also regulates 9 products to treat and improve the environment used in conditional import aquaculture with specific additional ingredients and conditions. For 9 products treating and improving the aquaculture environment already on the List of products permitted for circulation in Vietnam (already permitted for circulation) or having certificates of circulation in Vietnam, upon import, traders carry out customs procedures and carry out quality inspection according to the current regulations of the Ministry of Agriculture and Rural Development. In case the product is not included in the list of products permitted for sale in Vietnam (not yet permitted for sale), traders shall carry out procedures for registration of circulation of products before importing. The circular also stipulates that products of treatment and improvement of aquaculture environment mentioned in Appendix 4 if all conditions are met, when importing, traders only have to go through customs procedures and conduct inspection. Check the quality according to the current regulations of the Ministry of Agriculture and Rural Development.
